SolutionBased designs, manufactures, and distributes bathroom accessibility, mobility, and personal care equipment, including shower transfer systems, shower and commode chairs, bathing aids, accessories, and replacement parts.

By using our website or placing an order, you agree to these Terms and our applicable Shipping Policy, Return and Exchange Policy, and Privacy Policy.

Customers and caregivers must:
- Follow all applicable safety warnings and operating instructions.
- Observe the product's maximum user weight capacity.
- Confirm that the product is appropriate for the intended user and environment.
- Ensure that all components, locks, brakes, supports, and accessories are properly installed and functioning before use.
- Follow applicable transfer, positioning, and caregiver-assistance instructions.
- Inspect products regularly and discontinue use if damage, instability, or malfunction is identified.
- Avoid unauthorized modifications or uses outside the product's stated intended purpose.
Certain products may require caregiver assistance, appropriate transfer techniques, or evaluation by a qualified healthcare professional.
SolutionBased products are not substitutes for professional medical evaluation, treatment, or individualized clinical advice.
Customers should consult an appropriate healthcare professional when uncertain whether a product is suitable for a user's physical condition, transfer abilities, or care requirements.
Nothing in this section eliminates or limits SolutionBased's legal obligations concerning product safety, manufacturing defects, warranties, or product liability.
4. Product Specifications and Availability
SolutionBased makes reasonable efforts to provide accurate product descriptions, photographs, dimensions, specifications, and availability information.
However, product images may differ slightly from actual products due to display settings, manufacturing updates, or other factors.

7. Shipping and Delivery

Eligible direct-to-consumer purchases may qualify for complimentary standard ground shipping within the contiguous United States, subject to the exclusions and product-specific charges described in that policy.
Certain products, including Bathlyft units, parts, and accessories, may be subject to shipping charges.
Expedited delivery, special handling, shipments outside the contiguous United States, and certain freight services may involve additional charges.
Delivery dates and transit times are estimates unless expressly guaranteed in writing.
SolutionBased is not responsible for carrier delays or events beyond its reasonable control, except to the extent applicable law provides otherwise.
Customers must provide accurate delivery information and promptly notify SolutionBased of shipment discrepancies or damage.
Large or palletized orders may require appropriate receiving arrangements.

8. Returns, Exchanges, and Refunds
Returns and exchanges for eligible retail purchases made directly from SolutionBased are governed by our separate Return and Exchange Policy.
The policy includes requirements concerning:
- The applicable 30-day return request period
- Prior Return Merchandise Authorization (RMA)
- Product condition and cleanliness
- Complete original manufacturer packaging
- Return shipping responsibilities
- Product inspection and refund eligibility

SolutionBased does not charge restocking fees on eligible direct retail returns.
Wholesale and distributor restocking fees, if applicable, are governed by the relevant dealer agreement or written purchase terms.
Products purchased from independent dealers, distributors, retailers, or third-party sellers must generally be returned to the original seller under that seller's return policy.
Nothing in our Return and Exchange Policy limits remedies required by applicable consumer protection or warranty laws.

These Terms do not replace, reduce, or override any applicable written product warranty or legally required implied warranty.
In particular, nothing in these Terms disclaims implied warranties where such disclaimers are prohibited by the Magnuson-Moss Warranty Act or other applicable law.
10. Product Safety, Modifications, and Misuse
Customers must not modify, alter, or use SolutionBased products in ways that conflict with applicable safety instructions or the product's intended use.
Improper installation, unauthorized modifications, failure to maintain equipment, exceeding weight limits, or use contrary to safety warnings may create serious risks.
Customers should discontinue use immediately if a product becomes damaged, unstable, or unsafe.
Where misuse or unauthorized modification causes damage or contributes to a loss, responsibility will be determined under applicable law and the relevant product warranty.
Nothing in these Terms excludes or limits liability for defective products, personal injury, or other claims where such limitations are prohibited by law.
11. Wholesale Customers, Dealers, and Distributors
The retail purchasing provisions of these Terms apply primarily to purchases made directly through SolutionBased's consumer-facing online store.
Authorized dealers, distributors, institutional purchasers, and wholesale customers may be subject to separate written agreements, quotations, purchase terms, credit arrangements, and freight provisions.
Such agreements may establish:
- Wholesale pricing and discounts
- Credit limits and payment terms
- Freight responsibilities
- Minimum purchase requirements
- Returns and restocking fees
- Warranty administration
- Other negotiated commercial obligations
In the event of a conflict between these website Terms and an applicable executed dealer or distributor agreement, the dealer or distributor agreement will govern the relevant wholesale transaction, subject to applicable law.
The availability of retail website pricing does not create an entitlement to wholesale discounts or commercial credit terms.

Information published on our website is provided for general product education, purchasing assistance, and customer support.

Updated Terms will be posted on our website with a revised effective date.
Material changes will not retroactively alter completed purchases or existing contractual rights except as permitted by law.

An executed dealer or distributor agreement governs the relevant wholesale transaction when its provisions conflict with these website Terms.
Nothing in these Terms overrides nonwaivable statutory rights.
Failure by SolutionBased to enforce a provision on one occasion does not constitute a waiver of its right to enforce that provision in the future.
